Limitation of Our Liability

1.1 KORAA shall not be liable for the following:
a) Any loss of profit;
b) Any indirect, special, incidental, punitive, or consequential loss, damage, costs, or expenses (whether or not resulting from the negligence of KORAA, its employees, volunteers, or organizers) suffered by the individual, team, or participant that arise out of or in connection with the provision of KORAA services or programs.
KORAA does not exclude or limit its liability in circumstances where it would be unlawful to do so. This includes liability for death or serious personal injury caused by KORAA’s negligence.
1.2 Each individual contracting with KORAA as a team member, player, program participant, or otherwise under these Terms and Conditions (T&Cs) hereby agrees to release, discharge, covenant not to sue, and hold harmless KORAA, its officers, employees, agents, sponsors, advertisers, and any owners, operators, organizers, or volunteers of premises where KORAA programs take place, from all liability, claims, demands, losses, or damages arising from any act of negligence or gross negligence by such parties.
1.3 Participants agree to indemnify, defend, and hold harmless KORAA, its officials, representatives, officers, employees, agents, sponsors, advertisers, and any owners, operators, organizers, or volunteers of premises where KORAA programs take place, from any litigation expenses, loss, liability, damages, or costs incurred as a result of any claims arising out of or in connection with their participation.
a) The participants understand and agree that this clause 1.3 is intended to provide a complete and unconditional release of KORAA's liability to the fullest extent permitted by law. Should any provision within these T&Cs be found invalid, illegal, or unenforceable, that provision shall be severed, but the remaining provisions will remain in full force and effect.
1.4 KORAA shall not be liable for any loss, theft, or damage to personal property, including but not limited to clothing, equipment, or personal items (e.g., glasses, jewelry, electronic devices), whether brought by participants, spectators, or others, during the course of any KORAA program, event, or activity. Participants are solely responsible for securing their own belongings.

Risks of Personal Injury or Death Arising from Sporting Activities or Events

2.1 Participation in any sport or physical activity carries inherent risks, including the risk of personal injury or death, which cannot be entirely eliminated. By participating in KORAA’s programs or training sessions, you voluntarily accept and assume all risks associated with participation. You acknowledge and agree that KORAA has no duty or liability to you or any third party for risks inherent in these activities.
2.2 Rules of Participation:
a) You must act responsibly and sensibly at all times while participating in any KORAA program, activity, or event.
b) You must not be under the influence of alcohol or any non-prescription drugs during participation.
c) You must adhere to all safety instructions, warnings, or guidelines provided by KORAA staff or volunteers.
d) If you are unclear about any instructions, you must seek guidance from a KORAA staff member before proceeding.
2.3 KORAA does not and cannot guarantee that you are medically fit to participate in any sport or physical activity. You are solely responsible for seeking professional medical advice from your doctor or a healthcare provider to ensure that you are fit for participation.
2.4 In the absence of any negligence or breach of duty by KORAA, participation in any sport, program, or activity is entirely at your own risk.

Forfeits / No Shows

3.1 If an individual is unable to attend a scheduled game, program, or event, no reimbursement or refund will be provided for their absence.
3.2 If a team is unable to attend a scheduled game, the opposing team will automatically be awarded a win.
3.3 If a team forfeits twice during a single season, KORAA reserves the right to review the team’s continued participation in the league. KORAA may, at its sole discretion, remove the team from the league without obligation to provide reimbursement or compensation.
3.4 All attendees at KORAA leagues, tournaments, programs, or events are expected to conduct themselves in a civil and respectful manner towards players, referees, spectators, staff, organizers, and volunteers. Unsportsmanlike behavior, including verbal or physical abuse, will not be tolerated. Depending on the severity of the behavior, KORAA may take further action, including issuing official warnings, suspending individuals or teams, or expelling participants from the event or league. You acknowledge and accept that KORAA has the sole discretion to determine appropriate actions and has no obligation to follow a specific process or timeline in making such decisions.
3.5 If you believe that another attendee at a KORAA event has violated the conduct expectations outlined in clause 3.4, please report the incident via phone or email, which can be found on our website. When submitting a report, please include details about the league or event you attended and provide as much relevant information as possible.

Discipline

4.1 All decisions made by match officials or KORAA representatives (including staff or volunteers assigned to oversee the event) are final and must be respected. Any form of intimidation, harassment, or undue influence directed towards these individuals will not be tolerated. Such actions may result in disciplinary measures taken by KORAA, including but not limited to official warnings, suspensions, or the expulsion of offending participants, players, or teams from the league, program, or event.
4.2 KORAA reserves the right to take disciplinary action, including banning or expelling any participant, player, or team from the league, program, or event, if deemed necessary. KORAA shall have sole discretion in determining the appropriate disciplinary measures, and such decisions are final and binding.

Safety and Conduct

5.1 Rules:
a) No item of jewelry that is likely to fall off or pose a risk of injury shall be worn during games or any program with high levels of physical activity or competition.
b) No adornments or accessories that may endanger participant safety shall be worn.
c) Participants must wear suitable clothing and appropriate training shoes. Shoelaces must be securely tied before the start of any game or program with high levels of physical activity. Time allowances will not be provided for adjusting or tying shoelaces during the activity.
d) Participants and spectators acknowledge and accept full responsibility for any injuries or damages that may occur. By participating, individuals acknowledge the inherent risks involved in sports and other high-physical-activity programs, including physical contact, and accept all associated risks, losses, costs, and damages. KORAA does not provide personal injury insurance or insurance for player-to-player incidents. Participants are responsible for obtaining their own personal injury insurance.
5.2 Participants agree and acknowledge that KORAA does not own or have exclusive control over the premises used for its activities. As such, KORAA has limited control over persons entering the premises (including surrounding areas and other courts) and cannot ensure the condition of the premises before or after competitions. KORAA is not responsible for any loss or damage to personal property.
5.3 Smoking and consumption of alcohol are strictly prohibited at all premises used by KORAA.
5.4 KORAA reserves the right to ban or ask any individual(s) or entire team to leave if they breach any of the above rules.

General

6.1 Website images may not always represent the actual pitches or facilities used for leagues or programs. They are provided for illustrative purposes only.
6.2 KORAA may take photographs of league winners and teams for use in marketing materials and online platforms. KORAA owns the rights to these images and will use them for promotional purposes. By participating, players waive any moral rights, image rights, or rights of publicity or privacy concerning these images. If a team or player does not wish for their photos to be used, they must notify KORAA upon joining the league or program.
6.3 When registering as an individual, KORAA will assist in forming a new team for leagues or programs, which may include sharing your details with other players. By signing up, you consent to this information sharing.
6.4 KORAA reserves the right to subcontract, assign, or delegate any of its obligations under these T&Cs to third parties without prior notice.
6.5 KORAA will not be liable for any delays or non-performance of obligations caused by events beyond its reasonable control (“Force Majeure”), including but not limited to natural disasters, wars, civil unrest, utility failures, or government actions. In the event of Force Majeure, the performance timeline will be extended by the duration of the delay. If Force Majeure extends beyond [6 weeks], KORAA may terminate the contract with immediate written notice (including by email).
6.6 These T&Cs constitute the entire agreement between the parties and supersede all previous agreements, promises, assurances, and representations, whether written or oral, related to the subject matter.
6.7 Each party acknowledges that they do not rely on any statement, representation, assurance, or warranty not set out in these T&Cs.
6.8 No claims for innocent or negligent misrepresentation or misstatement shall be made based on any statements not included in these T&Cs.
6.9 Rights and remedies under these T&Cs are additional to those provided by law and not exclusive.
6.10 A party’s failure or delay in exercising any right or remedy under these T&Cs or by law does not constitute a waiver of that or any other right or remedy. No partial exercise of any right or remedy prevents further exercise of that or any other right or remedy.
6.11 These T&Cs and any disputes arising from them or their subject matter will be governed by the law of [jurisdiction]. Disputes will first be handled informally between the parties. If unresolved, disputes will be settled in the court of law.

Non-Compete

7.1 As soon as a participant registers for any of KORAA's leagues, programs, or events, whether or not they ultimately participate, they agree not to use or disclose any ideas, concepts, or formats from KORAA to create or develop competing sports leagues, programs, or similar activities for a minimum of five (5) years. This clause ensures that KORAA’s intellectual property and unique offerings are protected.

Terms and Conditions Agreement

ACCEPTANCE OF TERMS & CONDITIONS
In consideration of the acceptance of my membership in the KORAA program/event/league/activities, I, the participant, agree as follows:
1. Review and Agreement: I have reviewed the “Terms & Conditions” and my name and date affixed in this document indicate my agreement with the “Terms & Conditions” and “Terms Agreement” herein.
2. Policies and Regulations: I am aware of KORAA’s policies, rules, and regulations and agree to abide by them and to be bound by them.
3. Personal Possessions: I accept sole responsibility for my personal possessions and athletic equipment.
4. Liability for Damage: I accept all liability for any damage to the playing equipment caused by my careless, negligent, and/or improper handling.
5. Photographs and Videos: I understand that KORAA may take photographs or videos of participants. I grant permission without compensation that these photographs or videos may be used by KORAA for promotional or presentation material.
By providing my name and date below, you agree that you are the registrant being registered and to be bound by this Legal Agreement even if you have not read the agreement.
CONSENT FOR USE OF PERSONAL INFORMATION
I authorize KORAA to collect and use personal information about me for the following purposes:
1. Communications: To receive communications from KORAA.
2. Venue Booking: Disclosure of my name, email, and/or address to the respective venue(s) for the purpose of booking fields and/or venues.
3. Vendors: Sharing of my name, email, and other relevant information with third-party vendors (e.g., for jerseys, equipment, etc.) as necessary for the provision of services related to my participation in KORAA programs, leagues, or events.
I understand that I may withdraw such consent related to receiving communications at any time by contacting general@koraa.ca. KORAA does not sell or distribute personal information to any third party not listed herein.
WAIVER AND RELEASE OF LIABILITY
Please read carefully. By providing my name and date below, you will waive certain legal rights.
1. Binding Legal Agreement: This is a binding legal agreement. As a Participant in the programs, activities, and events of KORAA, the undersigned acknowledges and agrees to the following terms.
2. Liability: KORAA, their Districts, Leagues, and Clubs, directors, officers, members, employees, coaches, volunteers, officials, participants, clubs, agents, sponsors, owners/operators of facilities, and representatives (the “Organization”) are not responsible for any injury, damage, or loss of any kind suffered by a Participant during, or as a result of, any program, activity, or event, caused in any manner whatsoever including, but not limited to, the negligence of the Organization.
3. Risks and Hazards: I hereby acknowledge that I am aware of the risks and hazards associated with or related to any program offered by KORAA. The risks and hazards include, but are not limited to, injuries from:
a) Executing strenuous and demanding physical techniques
b) Failure to properly use any piece of equipment or from the mechanical failure of any piece of equipment
c) Spinal cord injuries which may render me permanently paralyzed
d) Extreme weather conditions which may result in heatstroke, sunstroke, or hypothermia
e) Contact, colliding, or being struck by other participants, spectators, equipment, or vehicles
f) Vigorous physical exertion and strenuous cardiovascular workouts
g) Exerting and stretching various muscle groups
h) Travel to and from competitive events and associated non-competitive events which are an integral part of the organization’s activities
4. Acknowledgment: I am aware that:
a) Injuries sustained can be severe and even be fatal
b) I may experience anxiety while challenging myself during the activities, events, and programs
c) I may come into close contact with other participants, including the possibility of accidental and unexpected contact
d) My risk of injury is reduced if I follow all rules established for participation
e) My risk of injury increases as I become fatigued
5. Agreement: In consideration of the Organization allowing me to participate as a Participant, I agree:
a) To assume all risks arising out of, associated with, or related to my participation
b) To be solely responsible for any injury, loss, or damage that I might sustain while participating
c) To release the Organization from liability for any and all claims, demands, actions, and costs that might arise out of my participation, even though such risks, injuries, loss, damage, claims, demands, actions, or costs may have been caused by the negligence of the Organization
CODE OF CONDUCT FOR REGISTRANTS
KORAA has a zero-tolerance policy for the following actions:
1. Disrespect of teammates, opponents, officials, staff, and spectators through the use of inappropriate language or gestures
2. Lewd behavior on and/or off the field
3. Physical altercations
4. Disregard for the rules and field etiquette on any of the fields used by KORAA
5. Consumption of alcohol, tobacco, illegal substances, and public urination on any fields used by KORAA
As a registrant with KORAA:
1. I will respect the officials and refrain from challenging an official's decision
2. I understand that it is my responsibility to report any incident of physical violence that I witness during or after a KORAA game.
Violation of this policy could result in disciplinary action by KORAA.
NON-COMPETE CLAUSE
1. Restriction: As a participant, you agree not to create, establish, or participate in any sports league, program, or event that directly competes with KORAA for a minimum of five (5) years following your registration with KORAA, regardless of whether you participate in the program, league, or event.
2. Scope: This restriction applies to all sports leagues, programs, or events similar to those offered by KORAA.
3. Breach of Clause: In the event of a breach of this clause, KORAA reserves the right to seek remedies as deemed appropriate under the law.
REFUND POLICY
KORAA adheres to a strict refund policy for registration fees paid online or in person. Please read below on the current refund policy at the time of your registration to any KORAA Program, activity, event, or league.
